Terms of Service

1. Service Overview

Tymon is a mobile application designed to provide users with pre-built watercolor flower templates and pressed-flower collage templates. Users may upload their own photos of wildflowers, natural scenery, and related content, select templates manually, and generate watercolor-style flower cards or pressed-flower keepsake cards for personal use. Generated works may be saved and exported locally on your device.

2. User Accounts & Eligibility

You must be at least 13 years old to use this Service. If you are under the age of majority in your jurisdiction, you may use Tymon only under the supervision of a parent or legal guardian who agrees to these Terms.
You are responsible for maintaining the confidentiality of any account credentials (if applicable) and for all activities that occur under your account.
You agree to provide accurate, current, and complete information when registering or using the Service, and to update such information to keep it accurate and complete.

3. Acceptable Use & User Conduct

You agree not to:

Use the Service for any illegal, unauthorized, or commercial purpose without our prior written consent.
Upload photos that contain third-party copyrighted content, trademarks, or personal information without explicit permission from the owner.
Modify, decompile, reverse-engineer, disassemble, or attempt to derive the source code of Tymon or any related technology.
Use the Service to harass, abuse, harm, or infringe upon the rights of other users or third parties.
Interfere with or disrupt the Service, servers, or networks connected to the Service.

4. User Content & Intellectual Property

When you upload photos to Tymon, you retain ownership of your original content. However, you grant us a limited, non-exclusive, royalty-free license to process, modify, and display your content solely for the purpose of providing the Service to you (e.g., applying templates and generating your works).

All templates, designs, graphics, and features within Tymon are the intellectual property of Tymon and are protected by copyright, trademark, and other laws. You may not copy, distribute, modify, or use our templates or features for commercial purposes without our prior written approval.

You are solely responsible for the content you upload and the works you generate using Tymon. We are not liable for any claims, damages, or losses arising from your content or use of generated works.

5. Paid Services & Payment Terms

Certain features of Tymon may be available through paid subscriptions or one-time purchases. By purchasing these features, you agree to the following:

All payments are non-refundable unless otherwise required by applicable law.
Subscriptions will auto-renew unless canceled at least 24 hours before the end of the current billing period.
We reserve the right to modify pricing for paid services at any time, with notice provided to users where required by law.
Failure to pay applicable fees may result in suspension or termination of your access to paid features.

6. Service Modifications & Termination

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may terminate or suspend your access to Tymon immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service ceases immediately.

7. Disclaimers of Warranties

TYMON IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

We do not warrant the accuracy, completeness, or reliability of any content generated through the Service, nor do we warrant that your use of the Service will not infringe on the rights of third parties.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TYMON, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THIS SERVICE.

Our total aggregate liability to you for any claim related to the Service shall not exceed the total amount paid by you to us in the twelve (12) months prior to the date the claim arose.

9. Dispute Resolution & Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Tymon operates, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service shall first be resolved through good faith negotiations. If unresolved, disputes shall be submitted to binding arbitration in accordance with applicable rules, or resolved in the courts of competent jurisdiction in our primary operating location.

10. Updates to These Terms

We may update these Terms of Service from time to time. When we make changes, we will revise the "Effective Date" at the top of this page and notify you through the Service or other reasonable means. Your continued use of Tymon after the changes take effect constitutes your acceptance of the new Terms.
